The terms that govern your use of the WiseTREND website. These do not replace the terms of any signed customer agreement.

Welcome to https://www.wisetrend.com (the “Site”), owned and operated by WiseTREND OCR & Data Capture, Inc. (“WiseTREND,” “we,” “us”). By accessing or using the Site, you agree to these Terms of Service. If you do not agree, please do not use the Site. Where you have a separate written agreement with WiseTREND for products or services, that agreement governs those services and prevails over these Terms in case of conflict.
1. Changes to these Terms
We may modify, update, or remove parts of these Terms at any time at our discretion. Changes are effective when posted, with an updated date above. Your continued use of the Site after changes signifies acceptance. Please review periodically.
2. Use of the Site
We may alter, suspend, or discontinue the Site or any part of it at any time, with or without notice, including for maintenance. You agree not to use the Site for any unlawful purpose, to infringe the rights of WiseTREND or others, to attempt to gain unauthorized access, to disrupt the Site, or to scrape or harvest data except as permitted by our robots policy. If you breach these Terms, we may revoke your access without notice.
3. Intellectual property & trademarks
All content on the Site—text, images, logos, software, and other materials—is owned or licensed by WiseTREND and protected by intellectual-property laws. You may not copy, distribute, or create derivative works from Site content without our prior written consent. WiseTREND names, logos, and marks may not be used without permission. ABBYY®, FlexiCapture®, and other third-party marks are the property of their respective owners.
4. Downloads & software
Any software offered for download is owned by WiseTREND or its licensors, protected by copyright, and governed by its applicable end-user license agreement (EULA). Unauthorized use is prohibited.
5. Your submissions
Any non-personal material or communication you submit through the Site (for example, feedback) is treated as non-confidential, and you grant WiseTREND a non-exclusive, royalty-free license to use it to operate and improve our services. Do not submit confidential or sensitive information through public areas of the Site. Personal information you provide is handled under our Privacy Policy.
6. Disclaimer of warranties
The Site and its contents, services, and features are provided “as is” and “as available,” without warranties of any kind, express or implied, including accuracy, reliability, merchantability, fitness for a particular purpose, and non-infringement. Your use of the Site is at your own risk.
7. Limitation of liability
To the fullest extent permitted by law, WiseTREND will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, or data, arising from your use of the Site. WiseTREND's total liability arising out of or relating to the Site will not exceed the greater of the amounts you paid to WiseTREND for Site access in the prior twelve months or US $100. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
8. Indemnification
You agree to indemnify and hold WiseTREND harmless from claims, damages, and expenses arising out of your misuse of the Site or violation of these Terms or applicable law.
9. Third-party links
The Site may link to third-party websites that WiseTREND does not control or endorse. We are not responsible for their content or practices; links are provided for convenience.
10. Governing law & venue
Except where applicable law provides otherwise, these Terms and any use of the Site are governed by the laws of the State of California, U.S.A., excluding its conflict-of-law rules. The exclusive venue for disputes will be the state and federal courts located in Santa Clara County, California.
11. General
If any provision of these Terms is held unenforceable, the remaining provisions remain in effect. Our failure to enforce any provision is not a waiver. These Terms, together with the Privacy Policy and any signed agreement, are the entire agreement regarding your use of the Site.
